The Albanese Labor Government is set to create a new Fair Work Court, saying it will deliver fairer and faster workplace justice.
According to the Government, the Fair Work Court will provide a specialist forum for resolving workplace relations disputes that works seamlessly with the Fair Work Commission.
Specialist judges with workplace relations expertise would sit on the court to support faster, simpler and more accessible dispute resolution. Anthony Albanese, the Prime Minister, said: “Australians who have been underpaid hundreds, even thousands, of dollars shouldn’t have to wait years for justice, or be told their case will cost more than their claim.”
The Government will consult workers, employers, and legal experts on the design of the proposed court this year.
This consultation will focus on how the court will work with the existing Fair Work Commission and how it will improve access to justice.
The Business Council of Australia did not agree that the proposal is the right way to address the complexity of current workplace laws.
Bran Black, BCA CEO, said: “For a small business, a case that costs more than it’s worth is not only unfair, it can be the difference between staying open or closing its doors.”
Black stressed that the new court will not bring any practical benefit, warning that the complexity will take workplaces back to the old days of more combative disputes, rather than encouraging a cooperative environment.
He added that judges must be appointed on merit, independent and impartial so that both workers and employers can trust that it is fair.
The BCA will engage closely on all the details and proposed arrangements, including on how the new court will interact with the Fair Work Commission and its processes, to ensure it delivers real solutions.
